Terms and Conditions

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. The Promoter is BLC International Pty Ltd trading as Australian School and Club Fundraising Specialists (ABN 45 116 799 181) of 12 Macadam Street, Seventeen Mile Rocks, QLD 4073 (“Promoter”).
  3. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Participation is only open to primary and secondary schools in Australia that are government schools or registered as non-government schools under the Education Act in force in each State or Territory (“Eligible School”). The Promoter retains absolute discretion whether to accept registration of an Eligible School in an Eligible Program (defined below). The Promoter will not accept any registration from home educators (whether registered or not) or pre/after school facilities.
  5. Entries into the promotion open on 22/1/2024 and close at 11:59PM AEDST on 8/12/2024 (“Promotional Period”).
  6. An eligible program is one of the following Promoter’s fundraising programs:
    • Colour Explosion School Run4Fun;
    • Slime Spectacular School Run4Fun;
    • Colour Splatacular School Run4Fun;
    • Standard School Run4Fun; and
    • Glowtastic Dance Party, (each an “Eligible Program”).
  7. To participate in this promotion, authorised representatives on behalf of an Eligible School must register the Eligible School into at least one (1) Eligible Program, and the Eligible School must fundraise a minimum of AU$1.00 for an Eligible Program during the Promotional Period.
  8. The Promoter reserves the right, at any time, to request proof of the authorised representative identity and appointment as authorised representative by the Eligible School (which may be provided in the form of email or letter from the Eligible School’s principal or such other responsible individual from the Eligible School). The Promoter may suspend an Eligible School’s access to the promotion if this information is not provided within a reasonable period of time.
  9. Any costs associated with participating in the promotion, including any tax liability incurred by participation, is the responsibility of the Eligible School.
  10. It is the responsibility of the authorised representatives of the Eligible Schools to ensure any permission required by the relevant education authorities is obtained as a condition of entry in the promotion.
  11. The Promoter reserves the right, at any time and in its sole discretion, to disqualify any Eligible School who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  12. Incomplete, indecipherable, or illegible entries will be deemed invalid.
  13. The winner determination will take place at the office of BLC International Pty Ltd, 12 Macadam Street, Seventeen Mile Rocks, QLD, 4073 on 13/12/2024 at 11:00AM AEDST. The winning Eligible School will be notified by email within five (5) days of the draw and will be published at www.australianfundraising.com.au by 14/12/2024.
  14. This is a game of skill and chance plays no part in determining the winning Eligible School.
  15. The winner will be the Eligible School with the highest fundraising average per student for an Eligible Program by an Eligible School. The fundraised amount will be calculated based on the total amount fundraised according to the online fundraising platform www.myprofilepage.com.au and divided by the Eligible School’s number of student enrolments for the same school term as the relevant Eligible Program. In the event of a tie between two (2) or more Eligible Schools, the winner will be determined by the highest overall fundraising amount, calculated based on the total amount fundraised by an Eligible School across all of the Eligible Programs during the Promotional Period.
  16. The Promoter’s decision is final and no correspondence will be entered into.
  17. The winning Eligible School will win the prize of $5,000.
  18. If for any reason the winning Eligible School does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.
  19. Total prize pool value is $5,000.
  20. Authorised representatives on behalf of the Eligible Schools consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible School; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  22. Any cost associated with accessing the online fundraising platforms is the Eligible School’s responsibility and is dependent on the Internet service provider used.
  23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible School; or (f) use of the prize.
  25. The Promoter collects personal information (“PI”) of authorised representatives of Eligible Schools in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://australianfundraising.com.au/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the authorised representative. The Privacy Policy also contains information about individuals may opt out, access, update or correct their PI, how individuals may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
