 TERMS AND CONDITIONS

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. The Promoter is BLC International Pty Ltd trading as Australian School and Club Fundraising Specialists (ABN 45 116 799 181) of 12 Macadam Street, Seventeen Mile Rocks, QLD 4073 (“Promoter”).
  3. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
  4. Entry is open to primary and secondary schools, childcare centres, sports groups or community groups in Australia (“Eligible Group”). The Promoter retains absolute discretion whether to accept registration of an Eligible Group in an Eligible Program (defined below). The Promoter will not accept any registration from home educators (whether registered or not) or pre/after school facilities.
  5. Entries into the promotion open on 08/7/2024 and close at 11:59PM AEDST on 13/12/2024 (“Promotional Period”).
  6. An eligible program is any one (1) of the Promoter’s fundraising programs available online at https://australianfundraising.com.au/ and listed below:
  • Billy G’s Gourmet Cookie Dough;
  • Colour Explosion School Run 4 Fun;
  • Slime Spectacular School Run 4 Fun;
  • Colour Splatacular School Run 4 Fun;
  • Standard School Run 4 Fun;
  • Glowtastic Disco Party;
  • Ghostastic Disco Party;
  • Colour Spooktacular School Run 4 Fun; and
  • Dolly’s Dream Colour Explosion Run 4 Fun

(each an “Eligible Program”).

  1. To participate in this promotion and receive entry into the draw, an authorised representative on behalf of an Eligible Group must register the Eligible Group into at least one (1) Eligible Program and complete the Eligible Program during the Promotional Period. For clarity, Eligible Groups must then complete their fundraiser by no later than 13/12/2024.
  2. Multiple entries permitted, subject to the following: (a) only one (1) entry is permitted for each registered Eligible Program; and (b) each entry must be submitted separately and in accordance with entry requirements.
  3. The Promoter reserves the right, at any time, to request proof of the authorised representative identity and appointment as authorised representative by the Eligible Group (which may be provided in the form of email or letter from the Eligible Group’s responsible individual/organiser). The Promoter may suspend an Eligible Group’s access to the promotion if this information is not provided within a reasonable period of time.
  4. Any costs associated with participating in the promotion, including any tax liability incurred by participation, is the responsibility of the Eligible Group.
  5. It is the responsibility of the authorised representatives of Eligible Groups that are part of the education industry to ensure any permission required by the relevant education authorities is obtained as a condition of entry in the promotion.
  6. The Promoter reserves the right, at any time and in its sole discretion, to disqualify any Eligible Group who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  7. Incomplete, indecipherable, or illegible entries will be deemed invalid.
  8. The draw will take place at the office of BLC International Pty Ltd, 12 Macadam Street, Seventeen Mile Rocks, QLD, 4073 on 16/12/2024 at 11:00AM AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winning Eligible Groups will be notified by email within five (5) days of the draw and will be published at australianfundraising.com.au on 16/12/2024.
  9. The first valid Eligible Group drawn will win $5,000.
  10. The next valid Eligible Group drawn will win $2,000.
  11. The next three (3) valid Eligible Groups drawn will each win $1,000.
  12. All prizes will be awarded to the Eligible Group in the form of an electronic funds transfer (EFT). Authorised representatives of each winning Eligible Group will be responsible for providing full and accurate bank details for the Eligible Group. The Promoter will not be responsible for incorrect details being provided, a banking institution rejecting an EFT payment, or any costs associated with locating any lost monies.
  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. Subject to the unclaimed prize draw clause, if for any reason the winning Eligible Group does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.
  15. Total prize pool value is $10,000. Prizes are not transferable or exchangeable.
  16. A draw for any unclaimed prizes may take place on 13/01/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winning Eligible Groups (if any) will be notified by email within five (5) days of the draw and will be published at australianfundraising.com.au on 13/01/2025.\
  17. Authorised representatives on behalf of the Eligible Groups consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Group; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  1. Any cost associated with accessing the online fundraising platforms is the Eligible Group’s responsibility and is dependent on the Internet service provider used.
  2. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  3. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Group; or (f) use of a prize.
  4. The Promoter collects personal information (“PI“) of authorised representatives of Eligible Groups in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://australianfundraising.com.au/privacy-policy/.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the authorised representative. The Privacy Policy also contains information about individuals may opt out, access, update or correct their PI, how individuals may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
